Assumption of Risk, Release of Liability, Waiver, Indemnification & Media Release
Training Location: Rare Body Pilates Studio · St. Petersburg, Florida
By signing this Agreement I acknowledge that I am voluntarily participating in The Pilates University ("TPU") Term Two Teacher Training Program (the "Program"), including all lectures, demonstrations, physical practice, Pilates apparatus training, observation hours, teaching practice, partner exercises, movement activities and workshops associated with the Program. I understand and agree to the following:
Pilates teacher training involves physical activity and use of Pilates apparatus, including reformers, towers, chairs, barrels, mats, springs, straps and boxes. I acknowledge that participation involves inherent and other risks, including but not limited to: muscle soreness, strains, sprains and overuse injuries; falls, slips, trips or loss of balance; joint, ligament, tendon or muscle injuries; back, neck, shoulder, wrist, hip, knee or ankle injuries; injuries from improper technique or use of equipment; injuries caused by the actions or negligence of another participant; equipment malfunction or failure; accidents while entering, exiting or moving through the facility; aggravation of pre-existing injuries, conditions or limitations; illness or communicable disease; emotional or psychological discomfort associated with physical training; and serious bodily injury, permanent disability or, in rare circumstances, death. I knowingly and voluntarily assume all such risks, known or unknown, foreseeable or unforeseeable, to the fullest extent permitted by Florida law.
I represent that I am physically and mentally capable of participating and that I have disclosed to my instructor any injury, limitation or medical condition affecting my ability to participate safely. TPU and its instructors are not my physician, physical therapist or healthcare provider, and Pilates instruction is not a substitute for medical advice, diagnosis or treatment. I agree to participate only within my own capabilities and to notify the instructor immediately of pain, dizziness, shortness of breath, discomfort or injury. I am responsible for modifying, stopping or declining any exercise I believe may be unsafe for me.
In consideration for being permitted to participate, I release, waive, discharge and covenant not to sue, to the fullest extent permitted by law, The Pilates University and Rare Body Pilates Studio, together with their owners, members, managers, instructors, educators, employees, contractors, agents, representatives, affiliates, successors and assigns (collectively, the "Released Parties"), from any and all claims, demands, causes of action, damages, liabilities, losses, expenses or costs arising out of or related to my participation in the Program, including claims for personal injury, illness, disability, death, property damage or loss of property, whether occurring on or off the premises in connection with Program activities.
To the fullest extent permitted by Florida law, I release and hold harmless the Released Parties from claims arising from their ordinary negligence or that of their employees, instructors, contractors, agents or representatives. Nothing in this Agreement releases any claim that cannot legally be waived.
Pilates equipment involves springs, moving components, straps, bars and platforms that may cause injury if used improperly. I agree to follow all safety instructions, to use equipment only as instructed, to ask questions when I do not understand how equipment should be used, and not to misuse, alter or modify equipment.
The Program includes partner work, peer teaching, demonstrations, physical corrections and tactile cueing. Physical contact may occur as part of legitimate Pilates instruction and teaching practice; I agree to communicate any boundaries regarding physical contact and understand that I may decline or request modification of a tactile cue. I acknowledge that fellow students are also participants in a teacher-training environment and that minor errors may occur during practice teaching. I agree to communicate respectfully and to report any concern, injury or unsafe situation to the instructor immediately.
I authorize TPU, Rare Body Pilates Studio and their representatives to obtain reasonable emergency medical assistance on my behalf when deemed necessary. I am solely responsible for all medical, ambulance, hospital, physician, treatment, medication and other healthcare expenses resulting from an injury or medical emergency. This authorization does not obligate any Released Party to provide or arrange treatment.
I am responsible for my personal belongings while participating. To the fullest extent permitted by law, I release the Released Parties from responsibility for loss, theft or damage to personal property brought onto or left at the training facility.
In-person training may expose me to communicable illnesses. I agree not to attend when I am experiencing symptoms of a contagious illness or when I have been instructed by a medical professional or public health authority to remain isolated, and I voluntarily assume the risks of in-person group training, to the extent permitted by law.
To the fullest extent permitted by law, I agree to indemnify, defend and hold harmless the Released Parties from claims, liabilities, damages, judgments, costs and reasonable expenses, including reasonable attorneys' fees, arising out of my negligent or intentional acts or omissions; my violation of this Agreement; my misuse of Pilates equipment; my failure to follow reasonable safety instructions; and any claim brought by or on behalf of me arising from circumstances for which I have expressly assumed responsibility under this Agreement.
TPU and/or Rare Body Pilates Studio may photograph, film or record my image, likeness, voice, name, participation and teaching demonstrations during the Program. I grant them and their owners, employees, contractors, agents, representatives, successors and assigns permission to record me during Program activities and to use, reproduce, edit, publish, distribute and display those materials for business, educational, marketing, advertising, promotional, social media, website, email, print and digital purposes — including Instagram and other social media platforms, the TPU and Rare Body Pilates Studio websites and social media, advertisements, marketing and educational content, training program promotion, reels and short-form video, photographs, email newsletters, printed materials and future promotional campaigns. Materials may be edited, cropped, combined with other images or recordings and distributed in any medium now known or later developed. I waive any right to inspect or approve the finished materials and any claim to compensation, royalties or ownership. I understand that content posted online may be shared or redistributed by third parties and that neither party can control third-party use after public distribution. I release the Released Parties from claims arising from the authorized use of my image, likeness, voice or recordings, to the fullest extent permitted by law.
Participation does not guarantee certification, completion, employment, teaching opportunities or acceptance by any third-party Pilates organization, studio, employer or certifying body. I must satisfy all Program requirements established by TPU to receive any applicable certificate or credential.
My participation is voluntary. I have had the opportunity to ask questions about the Program, its physical requirements and this Agreement before signing, and I am not required to perform any exercise or activity that I reasonably believe may be unsafe for me.
I have carefully read this Agreement and understand that I am giving up certain legal rights by signing it, including rights to bring certain claims against the Released Parties, and that it is intended to be legally binding. I am signing voluntarily and without coercion, having had the opportunity to seek independent legal advice.
If any provision of this Agreement is determined to be invalid, unlawful or unenforceable, that provision shall be severed or limited to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
This Agreement is governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
This Agreement constitutes the entire agreement between the participant and the Released Parties regarding the subject matter herein and supersedes any prior verbal or written representations. Any modification must be made in writing.
I have read and understand this Agreement in its entirety. I understand the risks associated with Pilates teacher training and physical activity and I voluntarily assume those risks. I agree to release and hold harmless the Released Parties to the fullest extent permitted by law and to follow all safety instructions provided during the Program. I understand the Media, Photography & Video Release and grant the permissions described above. I am responsible for determining whether I am physically capable of participating, I may seek independent legal advice before signing, and I understand that this Agreement is intended to be legally binding.
